3. Mr. Dayananda Mohapatra, learned counsel appearing for the Bhubaneswar Development Authority states on instruction that the additional construction by the petitioner has in fact been regularized.

4. This fact could not be brought to the notice of the Court when it passed the order dated 20th November, 2013.

5. In that view of the matter, the said order dated 20th November, 2013 is hereby recalled. The RVWPET is, accordingly, allowed and W.P.(C) No.8374 of 2009 is restored to file.
