The CMP has been filed assailing the order dated 17th July, 2013 (Annexure-4) passed by learned Civil Judge (Senior Division), Puri in C.S. No.558 of 2009, whereby an application under Section 4(4) read with Section 51 of the Odisha Consolidation of Holdings and Prevention of Fragmentation of Land Act, 1972 was allowed by abating the suit with regard to relief of declaration of right, title and interest, but holding that the prayer for permanent injunction is maintainable. 3.

Mr. Mohapatra, learned counsel for the Opposite Parties informed the Court that the suit has already been dismissed for default vide order dated 26th July, 2019. In view of the above, the CMP has become infructuous.
