1.This matter is taken up by hybrid mode.

2. Heard learned counsel for the parties.

3. Pursuant to the order of this Court, the Collector, Sundargarh appeared through virtual mode in Court today and on his behalf Mr. Biswajeet Mohanty, learned standing Counsel for School and Mass Education Department submitted the Proceeding of the District Level Transfer Committee(DLTC) meeting for intra district transfer of elementary teachers in Sundargarh district for 2021-22 held on 29.11.2021 which is under challenge.

4. It is submitted that although the petitioner has completed six years of service in the post of Sikshya Sahayak without break and was appointed as a regular Primary School Teacher with effect from 27.11.2018 and posted at Govt. Primary School, Bhaludarh but his application dated 26.07.2021 for transfer submitted through the Odisha Teacher Transfer Portal was neither considered nor any reason thereto has been assigned to

// 2 // him for non-consideration or uploaded the same in the website. In the above premises, the petitioner has approached the Director, Elementary Education, Odisha , Bhubaneswar on 20th December, 2021 by way of an appeal ventilating his grievances which is pending till date.

In view of such pendency of appeal (Annexure-5), the Director, Elementary Education, Odisha, Bhubanesar is directed to dispose of the appeal of the present petitioner within a period of thirty days from the date of presentation of certified copy of this order, failing which, the contempt proceeding shall be drawn against him.

6. Accordingly the writ petition is disposed of with the aforesaid observation.

7. The personal appearance of the Collector, Sundargarh is dispensed with.
