For the averments made in paragraph no.10 of the affidavit that not only there is commencement of the construction of the Gram Panchayat building but there is also development of the construction to the plinth level and further for the construction is also undertaken hardly over six decimals of land out of a whole patch of one acre and some odd, even assuming that such action is affecting the Petitioner in some effect, as the construction is taking place involving the Gochar land and without diversion of such land, in the event there was arrangement necessity, but however looking to the spending of public money and also looking to the stage of construction, this Court finds no scope to interfere in such matter. This Court, however, directs, there should not be further utilization of Gochar land illegally.
