Mr. Pandey, learned counsel for the petitioner undertakes to remove the defects including payment of authentication fee in course of the day and prays that the petition may be heard and disposed of since non-bailable warrant of arrest issued against the petitioner is pending execution.

The learned counsel for the petitioner submits that the petitioner was on bail but on the date fixed i.e. 12.01.2018, an application under Section 317(1) Cr.P.C. was rejected and thereafter, NBWA was issued against him and in the facts and circumstances of the case, it is prayed that the petitioner should be directed to surrender and go on bail which the Court is inclined to without considering the merits of the case.

Accordingly, it is ordered.

In the result, the CRLMC stands disposed of with a direction to the petitioner to surrender before the learned Assistant Sessions Judge, Hindol, Dhenkanal on or before 14th October, 2022 in C.T. (SS) Case No.81 of 2015 corresponding to Rasol P.S. Case No.45 of 2015 and in the event of his surrender, the court below shall release him on bail with conditions as deemed just and proper in the facts and circumstances of the case.

An urgent certified copy of this order be granted as per rules.
