This matter is taken up through video conference mode. 2.

Heard learned counsel for the Parties.

Since the Petitioner has statutory remedy of Appeal, this Court is not inclined to entertain the Writ Petition but however the grounds raised herein can very well be agitated and adjudicated before the appellate forum. Keeping this in view, the Writ Petition stands disposed of permitting the Petitioner to approach the Appellate Authority within two weeks from today along with necessary applications for condonation of delay and interim protection. In such event, delay shall be condoned, the Appeal shall be heard on merit and the Application for interim protection at the instance of the Petitioner shall also be disposed of within four weeks

// 2 // at least. For six weeks, there shall be status as on today in respect of the disputed property be maintained.

The Writ Petition stands disposed of accordingly. 5.

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the Parties may utilize a printout of the order available in the High Court's Website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587 dated 25th March, 2020, modified by Notice No.4798 dated 15th April, 2021 and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
