The Petitioner is a defaulter in a housing loan account availed for a sum of Rs.21,80,000/- from Bank of India, Tankapani Road Branch, Bhubaneswar. By filing the instant petition, challenge has been laid to the recovery process initiated under the SARFAESI Act including the auction sale notice of the mortgaged property fixing the auction sale on 25th February, 2022 towards the recovery of the outstanding liability.

At the outset, counsel for the Petitioner prays for permission to withdraw the writ petition as the loan account has been liquidated upon deposit of the settled amount between the parties. A memo to that effect has been filed in Court today, which is taken on record.
