Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 13.10.2021 in connection with Gosaninuagaon P.S. Case No. 138 of 2021 corresponding to G.R. Case No. 1765 of 2021 pending in the court of learned S.D.J.M., Berhampur for the alleged commission of offence under Sections 302/201/34 of IPC.

Considering the submissions made, the materials on record, the period of detention already undergone and the fact that the petitioner's implication in the case appears to be because of the fact that he was the owner of the auto rickshaw, in which the dead body of the deceased was carried to the hospital, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may
deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.
