The Petitioners having been implicated in Chandaka P.S. Case No.142 of 2019 corresponding to G.R. Case No.889 of 2019 registered for alleged commission of offence under Sections- 420/419/467/468/471/34 of the IPC, pending on the file of learned J.M.F.C. (O), Bhubaneswar has filed this application under section-438 of the Cr.P.C. for grant of anticipatory bail in the above mentioned case. 3.

Upon hearing learned counsel for the Petitioner and learned counsel for the State especially taking into account the submission of the learned counsel for the State that the Petitioner has prior involvement in a case of similar nature of the year 2019, I am not inclined to grant anticipatory bail to the Petitioner. It is, however, observed that in the event the

// 2 // Petitioner surrenders before the court in seisin of the case and moves for his release on bail, the same shall be considered on its own merit further taking into account the factum of grant of bail to the co-accused, without being influenced by this order and disposed of early in accordance with law so as to enable the Petitioner to approach the next higher forum early. 4.

The ABLAPL is accordingly disposed of.

Interim order passed on 27.02.2020 does no more survive.

Issue urgent certified copy as per rules.
