Heard learned counsel for the Parties.

Learned counsel for the Petitioner in a way to file Appeal involving Annexure-4 seeks withdrawal of the Writ Petition but however with liberty for the Petitioner to approach the Appellate Authority.

In the circumstance, the Writ Petition is permitted to be withdrawn with the liberty as prayed for. This Court observes, in the event the Appeal is filed along with an application for condonation of delay, if necessary taking the plea of approaching the wrong writ court under bona fide impression so also an application for interim protection within two weeks, delay shall be condoned and the appeal

// 2 // shall be heard on merit. In the event the Petitioner is still in occupation of the disputed land, he may be protected for four weeks, within which the application for interim protection shall be disposed of by the Tahasildar.
