1. This matter is taken up through hybrid arrangement.
2. This application has been filed by the petitioner with a prayer to extend the period of three weeks time to surrender by modifying the order dated 02.02.2022 passed by this Court in CRLMC No. 264 of 2022.
3. It is submitted that while disposing of the CRLMC No. 264 of 2022 this Court passed an order on 02.02.2022 with a direction to the petitioner to surrender before court in seisin over the matter within a period of fifteen days hence. Upon his surrender the court in seisin over the matter, shall consider for releasing him on bail with some stringent conditions so as to ensure his regular attendance before the court on each date of posting of the
// 2 // case. In addition to this, the petitioner shall deposit a sum of Rs.1000/- as cost for noncompliance of the court's order. It is further submitted that due to COVID-19 pandemic situation the petitioner could not consult with his advocate for which he failed to comply with the direction made against him as aforesaid. In addition to this, the petitioner is a daily labourer and staying in remote area.
4. Considering the aforesaid submissions and the facts of the case, the prayer for extension of surrender period is allowed to the extent of five days. Accordingly, the petitioner is directed to surrender before the court in seisin over the matter in the Special (POCSO) Case No.112 of 2014 on the file of learned Additional Sessions Judge-cum-Special Judge, Angul within a period of five days hence. The other parts of the order remain unaltered.
