Heard Mr. K.K. Rout, learned counsel for the petitioner and Mr. D.K. Mohanty, learned Additional Standing Counsel. 2.

According to Mr. Rout, the grievance of the petitioner relates to inaction of Opposite Party in settling a piece of land i.e., Plot No. 1508 under Khata No. 1375 in Mouza-Gopabandhu Nagar in Barhampur Tahasil in its favour though it has applied for such settlement.

During course of hearing, Mr. Rout submits that liberty may be granted to the petitioner to file an application afresh in proper form before the Tahasildar, Berhampur (Opposite Party No.4) and further prays that a direction be issued to the said Opposite Party to take a decision on such motion within a specific time period. 4.

Considering the submissions made and without expressing

any opinion on the merit of the case, this Court grants liberty to the petitioner to file an appropriate application as permissible under the Provisions of Odisha Government Land Settlement Act, 1962 read with Odisha Government Land Settlement Rule, 1983, within a period of fifteen (15) days along with a copy of this order before Opposite Party No.4. In the event, such an application is received by the Opposite Party No.4, he/she is directed to take a decision on the same in accordance with law within a period of six months and communicate the result of such exercise to the petitioner. 5.

Accordingly, this writ petition is disposed of. 6.
