Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.

The petitioners are in custody since 02.01.2022 in connection with Purunakote P.S. Case No.1 of 2022 corresponding to G.R. Case No.3 of 2022 pending in the Court of learned S.D.J.M., Angul for the alleged commission of offence under Sections 341/324/294/506/307/34 of IPC. 4.

It is alleged that the petitioners, who are father and son, assaulted the victim with sharp cutting weapon causing head injury, for which he was admitted in Kalinga Hospital, Bhubaneswar in a critical condition.

Learned State Counsel submits on instructions that the condition of the injured-victim is presently normal and that he has been discharged from the hospital.

Considering the submissions as above, materials on record and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioners be released on bail on

such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that they shall appear before the trial court on each date of posting of the case without fail.

The BLAPL is disposed of.

Urgent certified copy of this order be granted on proper application.
