This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned counsel for the State.

Limited grievance of the Petitioner in the present writ petition is that promotion of the Petitioner to the post of Odisha Revenue Service has not been considered by the authority on the ground that the CCR was not available. Such a plea taken by the authorities prima facie appears in vague to this Court.

It is submitted by learned counsel for the Petitioner that the representation of the Petitioner is still pending before the Revenue Divisional Commissioner, Northern Division, Sambalpur-Opposite Party No.3 and the said Opposite Party has not taken any decision on the representation of the Petitioner.

Mr. K.K. Nayak, learned counsel for the State submits that he has no objection, if a direction is given to the Opposite Parties to consider the representation of the Petitioner within a stipulated period

Having heard learned counsel for the parties, this Court disposes of the writ petition with a direction to the Petitioner to file a fresh representation before the Revenue Divisional Commissioner, Northern Division, Sambalpur-Opposite Party No.3 within a period of ten days from today. In the event such a representation is filed within the aforesaid period, the same shall be considered in accordance with law and the same shall be disposed by a speaking and reasoned order within a period of two months from the date of filing of fresh representation. Any decision taken on the same shall be communicated to the Petitioner within a period of ten days thereafter.

It is made clear that in the event the authorities come to a conclusion that the Petitioner is eligible, the case of the Petitioner shall be considered for promotion as expeditiously as possible and the Petitioner shall be given promotion from date similarly situated persons were given promotion.

With the aforesaid direction, the writ petition stands disposed of.

Urgent certified copy of this order be granted on proper application.
