This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 439 of Cr.P.C. in connection with Kalimela P.S. Case No.07 of 2021 corresponding to Special G.R. Case No.05 of 2021 pending in the Court of learned Sessions Judge -cum- Special Judge, Malkangiri for commission offence punishable under section 20(b)(ii)(C) of the NDPS Act.
The petitioner moved an application for bail before the Court of learned Special Judge, Malkangiri which was rejected on 20.01.2022.
// 2 // As per the orders dated 30.06.2022 and 15.07.2022, learned counsel for the State has obtained instruction from the O.I.C., Kalimela police station dated 16.07.2022 and submitted that the petitioner is having two criminal antecedents and both the cases are under the N.D.P.S. Act. The instruction filed by the learned counsel for the State is taken on record.
Considering the submissions made by the learned counsel for the respective parties, the nature and gravity of accusation and the instruction received by the learned counsel for the State, I am not inclined to grant bail to the petitioner. The prayer for bail stands rejected.
Accordingly, the BLAPL stands dismissed.
