1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 22nd September, 2021 in connection with Bhadrak Rural P.S. Case No.21/2021 corresponding to G.R. Case No.123/2021 pending in the court of learned S.D.J.M., Bhadrak for the alleged commission of the offence under Sections 457/380/34 of I.P.C.

4. The allegation is that the Petitioner committed theft of gold and silver ornaments and cash from the house of the informant by breaking upon the house door and almirah. As it appears, the bail application was rejected, inter alia, on the ground that the Petitioner has several criminal antecedents which, according to the learned State counsel, are 44 in number.

5. Considering the submissions made, the materials on record, the period of detention in custody and the fact of submission of charge sheet, I am inclined to allow the prayer for bail.

6. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the court below on each date of posting of the case and in case of even a single default, N.B.W, shall be issued by the said Court to take him to custody again. Further, he shall appear before the I.I.C., Bhadrak Rural P.S. once every fort-night till conclusion of the case and such fact shall be certified by the I.I.C. to the concerned court once every month

7. The BLAPL is disposed of.

8. Urgent certified copy of this order be granted on proper application.
