The matter is taken up through Hybrid mode.

Mr.S.Das, learned Senior Standing Counsel appearing for the Vigilance has apprised this Court that the judgment of conviction has been passed by the court below i.e., Special Judge, Special Court, Bhubaneswar in T.R.Cases No.13/48 of 2008/1989. 3.

On the contrary, Ms.S.Das, learned counsel appearing for the Petitioner has pointed out to us that the petition was filed for transfer of the said case to the court of the competent jurisdiction, inasmuch as it has been asserted by the Petitioner that the Special Court, Vigilance, Bhubaneswar does not have the jurisdiction to try the case, being T.R.Cases No.13/48 of 2008/1989.

Be that as it may, since the judgment of conviction has been delivered terminating the trial, this Court cannot pass any order transferring the case to any other court. The remedy that is available

to the Petitioner, according to Ms.Das, learned counsel for the Petitioner, has been availed by the Petitioner by filing an appeal. 5.
