Mr. Jena, learned advocate appears on behalf of petitioners. He submits, his clients are unfortunate parents of their college going son, who died by drowning. Prayer in the petition is for aggregate compensation of Rs.15 lakhs, including ex-gratia of Rs.4 lakhs already paid. 2.

Mr. Das, learned advocate, Additional Standing Counsel appears on behalf of State and submits, the victim, along with others, ventured into prohibited area of the river. There was great depth. There were warning signs and barricade put up by the administration. In spite thereof the mishap happened. Mr. Jena disputes any step was taken to warn the public of danger.

Since ex-gratia has already been paid, belatedly as submitted by Mr. Jena, this Court is not inclined to pass any order in the writ petition, leaving petitioners at liberty to

// 2 // initiate action for damages in the civil Court, being the proper forum.

The writ petition is disposed of.
