Considering the genuine grounds in filing this Application justifying the non-filing of written note of submission by the Petitioner, this Court is inclined to allow this CMAPL thereby restoring W.P.(C) No.8346/2009.

This Court records the statement of Mr.D.K.Mishra, learned counsel for the Bank that for vacation of the interim order on the dismissal of the Writ Petition for non-filing of written note of submission, there has been further development creating embargo in consideration of the Writ Petition.
