ORDER

1. This matter is taken up by video conferencing mode. Order No.

It is seen from a letter dated 5th August 2020 written by the Director of Mines, Odisha to the Under Secretary to Government of India, Ministry of Mines (Annexure-4) that the matter regarding lifting and selling of river sand is being dealt with by the Revenue and Disaster Management Department and that the Petitioner's letter with the enclosures for grant of permission to export sand was being transferred to the said Department for further action.

3. A direction is accordingly issued to the Additional Secretary to Government (Minor Minerals), Revenue and Disaster Management Department, Bhubaneswar (Opposite Party No.3) to examine the aforementioned letter with its enclosures in regard to the Petitioner's application for permission to export river sand and communicate to the Petitioner the decision not later than 11th April, 2022. A downloaded copy of this order shall be produced before Opposite Party No.3 by the Petitioner not later than 14th February 2022 for

appropriate action. The decision of Opposite Party No.3 be taken preferably after giving the Petitioner an opportunity of hearing.

4. If the Petitioner is aggrieved by such decision, it will be open to the Petitioner to seek appropriate remedy in accordance with law. The Court clarifies that it has not expressed any view in the matter. The writ petition is disposed of in the above terms.

5. As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020, modified by Notice No.4798, dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos. No.514 and 515 dated 7th January, 2022.
