application U/o.39 rule 1 & 2 of C.P.C and such order being confirmed by the lower appellate court, this Court declines to interfere in such order at this stage. If the Petitioner is so advised, may apply for early disposal of the suit.

The C.M.P. is accordingly disposed of with the above direction.
