This matter is taken up through video conference mode. Order No.

Heard learned counsel for the Parties.

While bringing to the notice of this Court the operation of a status quo order involving C.S. No.450/2021, this Court at the same time finds, there is pendency of a mutation proceeding, vide Mutation Case No.8373 of 2021. The status quo order involving the Civil Suit always relates to maintenance of the position of the land involved in the suit as on that date and in respect to parties involved therein. The mutation proceeding matter leads in preparation of Record. In the event there is finality to the mutation proceeding, this

// 2 // Court keeping in view the pendency of the Civil Suit between the Parties observes, any result involving the mutation proceeding shall be ultimately abided by the decision in the Civil Suit. Mutation Case No.8373 of 2021, if pending, may be decided accordingly but however considering the objection of the Petitioner, if any. 4.

The Writ Petition stands disposed of accordingly. 5.

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the Parties may utilize a printout of the order available in the High Court's Website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587 dated 25th March, 2020, modified by Notice No.4798 dated 15th April, 2021 and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
