Heard Mr. S.K. Dash, learned Counsel for the Petitioners and Mr. R. Sharma, learned Counsel for Opposite Parties. 3.

The Petitioners have filed this Writ Petition seeking to quash the notice dated 28.12.2019 terminating the agreement vide Annexure-1 and the notice dated 18.01.2020 bearing NIT No. MCL/SBP/GM (CMC)/NIT-141/2020/809.

Since the period of tender has already been over, the Writ Petition has become infructuous. However, if dispute regarding the tender is subsisting, it is open to the Petitioners to pursue their remedy in terms of the DTCN/ Agreement, which is applicable to them. 6.

With the aforesaid observation, the Writ Petition stands disposed of.
