Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 30.10.2021 in connection with Malkangiri P.S. Case No.503 of 2021 corresponding to G.R. Case No.985 of 2021 pending in the Court of learned S.D.J.M., Malkangiri for the alleged commission of offence under Sections 370/370-A/376(2)(n)/34 IPC read with Section 3/4/5/6/7 of Immoral Traffic (Prevention) Act.

It is alleged that one Abhijit Barman called the victim lady from West Bengal on the pretext of arranging a job for her at Malkangiri. On good faith, the victim came to Malkangiri but the said Abhijit Barman introduced her with the petitioner and kept her in a house owned by him. The petitioner is said to have had repeated sexual intercourse with the victim against her will and ultimately they all engaged her in prostitution. One of the coaccused, Ananta Barai @ Chotu has been released on bail as per order passed by this Court in BLAPL No. 813 of 2022.

Taking into consideration the above facts, the fact that charge sheet has already been submitted and the period of detention of the petitioner in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
