This matter is taken up through Hybrid mode.

None appears for the Petitioner at the time of call. 3.

Petitioner in this writ petition seeks to assail the office order dated 12th July, 2012 (Annexure-7) issued by Rent Officer, G.A. (Rent) Department, Government of Odisha, Bhubaneswar directing him to vacate Quarters No.38/3, TypeIV, Unit-1, Bhubaneswar and to pay all the dues in respect of the said quarters till the date of vacation.

Intervention application was also filed by Somanath Shastry (OP No.3) claiming that he was never issued with any notice for vacation of the said quarters.

This Court, vide order dated 16th May, 2013, while issuing notice in the matter of admission directed stay operation of order under Annexure-7 till 31st August, 2013. No step was taken thereafter by the Petitioner either to get the matter listed

// 2 // or to extend the interim order. In that view of the matter, this Court feels that the Petitioner has lost interest in pursuing the writ petition.

Accordingly, the writ petition stands dismissed for nonprosecution. Intervention Application is also disposed of accordingly.

Interim order dated 16th May, 2013 passed in Misc. Case No.2945 of 2013 stands vacated.

A free copy of this order be made available to Mr. Mishra, learned AGA for communication and compliance. Issue urgent certified copy of the order on proper application.
