This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Bargarh P.S. Case No.4 of 2021 corresponding to C.T. Case No.4 of 2021 pending in the Court of learned S.D.J.M., Bargarh for alleged commission of offences under sections 409 and 420 of the Indian Penal Code.

Considering the submission made by the learned counsel for the State that the petitioner is having no criminal antecedent and the offences are triable by

// 2 // Magistrate and taking into account the amount of cheating as alleged by the informant and the fact that the petitioner is on interim bail and there is no allegation that he has misutilized his liberty, the interim order dated 26.02.2021 is made absolute. The ABLAPL is accordingly disposed of.
