1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 7th January, 2022 in connection with Khallikote P.S.

Case No.18/2022 corresponding to G.R. Case No.41/2021 pending in the court of learned J.M.F.C., Khallikote for the alleged commission of the offence under Sections 498-A/302/34 of I.P.C. and Section 4 of the D.P. Act.

4. The allegation is that the Petitioner being the husband of the deceased subjected her to mental and physical cruelty in connection with demand for further dowry. However, from the

// 2 // statement of the minor children of the deceased and the Petitioner, it is revealed that on the date of occurrence, there was a petty quarrel between the husband and wife over purchase of grocery items and nothing has been stated by any of them to implicate the Petitioner. Nothing is also forthcoming from the materials on record as to the reason of commission of suicide by the deceased.

5. Taking into consideration all the above facts, the materials on record, the period of detention in custody and the fact that charge sheet has been submitted in the case, I am inclined to allow the prayer for bail.

6. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the court below on each date of posting of the case without fail.

7. The BLAPL is disposed of.

8. Urgent certified copy of this order be granted on proper application.
