ORDER

18.05.2022 Order No.

01.

1. Since the copy has already been filed and memo of undertaking has been filed, the defects are ignored.

2. Heard Mr. A.K. Sahoo, learned counsel for the Petitioner as well as Mr. K. Das, learned A.S.C. for the State-Opposite Party.

3. The grievance of the Petitioner is to further cross examine the victim on recall under Section 311, Cr.P.C.

4. Upon hearing both the parties and considering the age of the victim, who is a minor girl aged about 4 years only and the provisions prescribed under Section 33 (5) of the POCSO Act, I do not find any merit in the challenge of the Petitioner.

5. As such, the CRLMC is dismissed.
