Perused the office note that there is typographical error crept in the order no.5 dated 12.08.2022 that in the 2nd line of paragraph-2 and 2nd line of paragraph-4 it has been inadvertently mentioned as "W.P.(C) No. 7096 of 1999" instead of "OJC No. 7096 of 1999." 3.

Therefore, the order dated 12.08.2022 passed in CMAPL No. 26 of 2018 is recalled and fresh order is passed in in CMAPL No. 26 of 2018 in a separate sheet.

This application has been filed for recalling of the order dated 22.01.2016 and for restoration of the OJC No. 7096 of 1999, which has been dismissed for non-prosecution, to its file. 3.

Mr. A.K. Nath, learned Counsel appearing for the Opposite Party-Bank contended that he has no objection in the event the Writ Petition is restored to its file.

Having heard learned Counsel for the parties, the Order dated 22.01.2016 passed in OJC No. 7096 of 1999 is recalled and the Writ Petition is restored to its file.
