Undisputedly there is already disposal of so many encroachment cases in the meantime. Even though it is submitted that the Petitioner is residing over the disputed property in question for over last 30 years and going on paying fine depending on the assessment made by the competent authority on each such occasion, but the Petitioner has never applied for settlement of the disputed land in question during pendency of such proceeding.

Considering the submission made by the learned counsel for Petitioner and for the clear provision contained in Section 8-A of the O.P.L.E Act, this Court finds, there is no scope for considering the request for settlement of the land at this stage. In the circumstance, this Court finds there is no substance in the writ petition, which is, hereby, dropped.
