Opposite Party(s) Mr. S.P.Panda, AGA.
CORAM:
JUSTICE BISWANATH RATH
ORDER
18.07.2022 1.
This writ petition involves the following prayer: Order No.
"Hence, it is graciously pray to allow this Writ Application of the petitioner and to dispose the Representation petitioner and direct the OP. parties 1 to 5 to execute the WILL and to make mutation according to the WILL on dtd.26.09.2001 and rectified the defective mutate patta and a fresh mutate patta rectified may be executed in the favour of petitioner.
And further be pleased to pass any other order or orders as this Hon'ble court may deem fit and proper in the eye of law. And for this act of kindness, the petitioner shall as in duty bound ever pray."
2.
Learned counsel for the petitioner attempted to substantiate the prayer made in writ petition and submits that the petitioner has a representation pending before the Tahasildar concerned. This Court finds no representation will suffice in achieving a mutation attempt for the specific provision. For the provision already prescribed in the Mutation Manual, it may be open for the petitioner to apply under appropriate provision of law to the Tahasildar for taking a decision on the request of the petitioner.
3.
With this observation, the writ petition stands disposed of. (Biswanath Rath) Judge Sks
