IN THE HIGH COURT OF ORISSA AT CUTTACK

W.P.(C) No.3355 of 2022 Ram Chandra Laguri ....

Petitioner Mr. P. Das, Advocate -versusState of Odisha and others ....

Opposite Parties Mr. A. P. Das, ASC and Mr. L. N. Rayatsingh, Advocate for Opp. Party No.6

CORAM:

THE CHIEF JUSTICE JUSTICE R. K. PATTANAIK Order No.

ORDER

23.06.2022 03.

1. This petition, dressed up as a Public Interest Litigation (PIL), purportedly seeks the removal of encroachments on public land. However, strangely only one instance of an alleged encroachment has been picked up by the Petitioner and that person is sought to be impleaded as Opposite Party No.6. The Court repeatedly asked learned counsel for the Petitioner why he was being selective about one person's encroachment and not concerned about the other encroachments. There is no convincing reply forthcoming from the learned counsel for the Petitioner.

2. In the circumstances, the Court is not prepared to entertain the present PIL in the present form. It is accordingly dismissed. (Dr. S. Muralidhar) Chief Justice (R. K. Pattanaik) Judge M. Panda
