Heard Mr. D.P. Dash, learned counsel appearing on behalf of the petitioner and Mr. S. Mohanty, learned counsel for the opposite parties 1 and 2.

The petitioner has filed this writ petition seeking direction to opposite parties 1 and 2 to allow her to continue B. Arch Course 2017 till its end without causing any impediment and to set aside the decision taken by the opposite parties for withdrawal of the petitioner from B. Arch Course 2017.

Mr. B. K. Dash, learned counsel for the petitioner very fairly states that so far as the continuance of the petitioner in B. Arch Course 2017 is concerned, the said period has already over and as such, by efflux of time the same has become infructuous. So far as the refund of the fees, which has been acknowledged by the University is concerned, that should have been refunded to her, because she had not prosecuted her study in the University. 5.
Mr. S. Mohanty, learned counsel for the opposite parties 1 and 2 contended that since the petitioner had not prosecuted her study under the university and she has already taken back all the
documents, if at all any dues is there which she is entitled to get, the authority concerned shall consider and refund of the same to the petitioner.

Having heard learned counsel for the parties and after going through the record, so far as continuance of the petitioner in B. Arch. Course 2017 is concerned, since the period has already been expired by efflux of time, such prayer has become infructuous. So far as the refund of the amount is concerned, the opposite parties 1 and 2 shall do well to consider the same and refund the dues to the petitioner, which she has deposited, as early as possible, preferably within a period of two months from the date of communication of the order.

With the aforesaid observation and direction, the writ petition stands disposed of.
Issue urgent certified copy as per rules.
