2. Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.
3. The petitioner is in custody since 12.12.2021 in connection with C.T. (Spl) No. 50 of 2021 corresponding to Jharsuguda GRPS Case No. 71 of 2021 pending in the court of learned Addl. Sessions Judge-cum-Special Judge, Jharsuguda for the alleged commission of offence under Sections 20(b)(ii)-Bof NDPS Act.
4. Considering the submissions made and the fact that the seized contraband is less than commercial quantity weighing 8Kg. 100 grms of ganja, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that out of two sureties for such amount as may be fixed by the court below, one should belong to Jharsuguda district and further that the petitioner shall not leave the territorial
jurisdiction without seeking leave of the Court.
5. The BLAPL is accordingly disposed of.
6. Urgent certified copy of this order be granted on proper application.
