Heard Mr.N.R.Routray, learned counsel for the petitioner and Mr.P.K.Parhi, learned ASGI along with Mr.S.Panda, learned Central Government Counsel for the opposite parties.

The petitioner has filed this writ petition seeking to quash the order dated 10.08.2016 in O.A. No.579 of 2012 and order dated 06.10.2016 in Review Application No.8 of 2016 passed by the Central Administrative Tribunal, Cuttack Bench, Cuttack, by which the tribunal dismissed the O.A. filed by the petitioner and the same has also been confirmed in the Review Application. 4.

Learned counsel for the petitioner contended that this question has been decided by the apex Court in Union of India and others v. Rakesh Kumar and others in Civil Appeal No.3939 of 2017 disposed of on 24.03 and the same has been placed on record by way of an rejoinder affidavit filed by the petitioner as Annexure-8 to the writ application and further contended that this writ petition may be disposed of in terms of the said judgment. 5.

Mr.P.K.Parhi, learned ASGI contended that he has received

copy of the rejoinder affidavit and will verify the same and further contended that when this case is covered by the aforesaid judgment, the same may be disposed of the in view of the said judgment. 6.

Having heard learned counsel for the parties and after going through the record, it appears the claim of the petitioner having been covered by the judgment of the apex Court as mentioned in Rakesh Kumar and others (supra), this writ petition is disposed of in terms of the said judgment.
