IN THE HIGH COURT OF ORISSA AT CUTTACK

W.P.(C) No.9768 of 2014 Gopal Chandra Sahoo .... Petitioner Ms. Suchismita Sarangi, Proxy Counsel on behalf of Mr. Alok Kumar Mohapatra, Advocate -versusBranch Manager, State Bank of India, Badashankha Branch, District-Puri & Others .... Opp. Parties None for the Bank

CORAM:

JUSTICE JASWANT SINGH JUSTICE M.S. RAMAN ORDER (Oral) 12.07.2022 Order No.

02.

1.

This matter is taken up through hybrid arrangement (virtual/physical mode).

2.

The petitioner is stated to have availed a Housing loan for a sum of Rs.3.50 lakhs from State Bank of India, Badasankha Branch, Puri, which was classified as NPA on 28.02.2007 for non-deposit of the due installments.

3. It appears that the Bank vide Memo dated 24.04.2014 (Annexure-1) advised the petitioner to regularize the account by payment of outstanding installments failing which the Bank would proceed to issue a notice under Section 13(2) of the SARFAESI Act. In response, the petitioner made an application

// 2 // dated 12.05.2014 (Annexure-2) for settlement of the account under One Time Settlement.

4. It is apparent that the writ petition has come for hearing before this Court today itself, i.e., after a delay of almost eight years. Learned counsel for the petitioner states that she has no instructions in the matter.

5. In view of the above, the petitioner having shown no interest in pursuing the present writ, it can be safely construed that by efflux of time the present writ petition has become infructuous.

6. The writ petition is dismissed as infructuous. (Jaswant Singh) Judge (M. S. Raman) Judge AKK 12th July, 2022 Cuttack
