The petitioner has filed this writ petition seeking direction to the opposite parties to modify and sanction the Grade pay in 3rd RACP under Annexure-2 and allow grade pay of Rs.5400/- in the scale of pay of Rs.9,300-34,800/- with effect from 19.10.2013, as has been extended to similarly situated employees under Annexure-4 by considering Annexure-3 with all consequential service and financial benefits within a stipulated period. 3.
Mr. M. Pati, learned counsel for the petitioner contended that similar matter had come up for consideration before this Court in W.P.(C) No. 28016 of 2019 (Mangaraj Swain v. State of Odisha and others), wherein such benefit has been extended to the petitioner in the said writ petition under Annexure-4. It is contended that since the petitioner stands in the same footing, the benefit should have been extended in favour of the petitioner.

Considering the contention raised by learned counsel for the petitioner and after going through the records, this writ petition stands disposed of directing opposite party no.2 to consider the representation of the petitioner in the light of the order passed by this Court in W.P.(C) No. 28016 of 2019 (Mangaraj Swain v. State of Odisha and others), and taking into consideration Annexure-4, as expeditiously as possible, preferably within a period of three months from the date of production of certified copy of this order.
Issue urgent certified copy as per rules.
