This matter is taken up through hybrid arrangement (virtual/physical mode).

2. Petitioner is stated to be a defaulter of a Term Loan availed for purchase of a vehicle for a sum of Rs.90 Lakhs in the year 2012 from the Bank of India, Mahanadibihar Branch, District-Cuttack.

3. By filing the present Writ Petition, challenge is laid to the recovery process initiated under the SARFAESI Act, 2002.

4. At the time of hearing, learned counsel for the parties are agreed that the present Writ Petition has become infructuous in view of the loan account

// 2 // having been liquidated upon deposit of the amount settled under an OTS policy.

5. In view of the above, the Writ Petition is dismissed as infructuous.
