Heard learned counsel for the Petitioner.

The case of the Petitioner is that though he is the auction purchaser of the vehicle bearing registration number OD-05-AH-7558 in an auction by the Finance Company, but the R.T.O., Cuttack is not accepting the tax from him and as such he seeks a direction to the opposite party no.1 to accept the tax without penalty and transfer the ownership in his favour.

It appears that there was arrear tax and penalty due on the said vehicle. The vehicle has been auctioned by the Finance Company and no steps have been taken to cancel the registration as required under Section 51(5) of the M.V Act by the Finance Company. As such the vehicle is presently not registered in the name of the Petitioner on transfer. In such premises, the prayer made by the Petitioner is devoid of merit. 5.

Accordingly, the Writ Petition stands dismissed. (S. Pujahari) Judge PKS
