This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Baripada Town P.S.
Case No.50 of corresponding to C.T. Case No.117 of 2022 pending in the Court of learned S.D.J.M., Baripada for alleged commission of offences under sections 323/325/341/294/506 of the Indian Penal Code.
Perused the F.I.R.
As per the order dated 09.02.2022, the learned counsel for the State produced the written instruction obtained from the Inspector in-charge of Baripada Town police station, which indicates that the petitioner appeared
// 2 // on 04.03.2022 at 10.00 a.m. as per the order passed by this Court for the purpose of investigation of the case and fully cooperated in investigation and during his appearance, the Investigating Officer interrogated him and the interrogation was satisfactory and no further interrogation is required in the case.
Learned counsel for the State has produced the injury report of injured Debasish Mohapatra and submitted that the investigation is still under progress. Considering the submissions made by the learned counsel for the respective parties, since the petitioner has complied with the order of this Court dated 09.02.2022 and cooperated with the investigation of the case and no further interrogation is necessary, the interim order dated 09.02.2022 is made absolute.
The ABLAPL is accordingly disposed of.
Urgent certified copy of this order be granted on proper application.
