1. Challenging the order dated 21st March, 2017 taking cognizance of offence under Sections 294/323/325/341/352/379/506 of the IPC by the learned S.D.J.M., Panposh at Rourkela in 1CC Case No. 13 of 2017, the Petitioner has approached this Court under Section 482 of the Code of Criminal Procedure with a prayer to quash the same.

2. This Court while issuing notice vide order dated 22nd August, 2017, directed stay of further proceeding in the said case.

3. At the time of hearing today, a memo has come to be filed by Mr. Adhikari Chittaranjan Das, Advocate appearing on behalf of the Petitioner seeking permission to withdraw the petition on instruction from the Petitioner, Janhabi Behera. The said memo is taken on record.

4. In view of the above, the CRLMC is dismissed and the interim order passed on 22nd August, 2017 by this Court is vacated.

5. A copy of this order be communicated to the court below forthwith.
