2. Heard Mr. B.K.Das, learned counsel for the Petitioner and Mr. S.K.Mishra, learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 29th April, 2021 in connection with Aska P.S. Case No.167/2015 corresponding to S.T. Case No.68/2021 (arising out of G.R. Case No.380(B) of 2015) pending in the court of learned Addl. Sessions Judge, Aska for the alleged commission of the offence under Section 302/201/120-B/34 of I.P.C and Section 25(1-B)(a) of Arms Act. It is submitted that the Petitioner stands on the same

// 2 // footing as the co-accused persons, who have already been released on bail.

4. Considering the submissions made, the materials on record, the period of detention already undergone and the fact the coaccused persons, who stand on the same footing have already been released on bail, I am inclined to allow the prayer for bail.

5. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the court below on each date of posting of the case without fail.

6. The BLAPL is disposed of.

7. Urgent certified copy of this order be granted on proper application.
