Mr. Khuntia, learned advocate appears on behalf of petitioner and submits, opposite party financier be directed to consider his client's case in line with order dated 28th January, 2022 passed by a coordinate Bench in W.P.(C) no.2086 of 2022 ( Saroj Kumar Ojha v. HDB Financial Service Ltd.). He submits, his client will pay 50% of the outstanding at first instance on assurance by the financier that the vehicle will not be taken away. The balance his client will repay in instalments.

Mr. Mohapatra, learned advocate appears on behalf of the finance company and submits, 70% needs to be paid up front.

Petitioner will approach the finance company and express his intention and readiness in liquidating the outstanding, partly upfront and the rest by instalments. Opposite party financier will consider petitioner's approach.
