This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner was originally arrested on 28.01.2017 and was released on bail. Meanwhile, on 23.06.2021 the petitioner was arrested in another case in Jeypore Town P.S. Case No. 66 of 2021 and on 19.07.2021 he was remanded in the present case. It is submitted that because of communication gap, the petitioner could not instruct his lawyer properly, as a result of which no steps were taken.

Having regard to the submissions as above and the fact that the petitioner was earlier on bail, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of
posting of the case without fail.

BLAPL is accordingly disposed of.
