The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") has prayed for quashing of the F.I.R. in Balasore Vigilance P.S. Case No.31 of 2011 corresponding to VGR Case No.31 of 2011 pending on the file of the learned Special Judge (Vig.), Keonjhar.

None appears for the petitioner. However, Mr. Pani, the learned Senior Standing counsel appearing for the Vigilance Department submits that the trial of the aforesaid case is in progress and in the meanwhile eleven witnesses have already been examined.

Be that as it may, since no one appears for the petitioner at the time of call and this case is of the year 2014 and eight years have already been passed from the date of filing of this case, this CRLMC stands dismissed for non-prosecution, inasmuch as the petitioner appears to be a recalcitrant litigant and has lost interest in the present litigation. 5.

A copy of this order be communicated to the Court below forthwith.
