Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner was earlier on bail, but because of default in his appearance NBW was issued on the strength of which he was arrested on 31.08.2021. His application for bail being rejected by learned court below, he has approached this court for bail. 4.

Considering the fact that the petitioner was earlier on bail, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall not default in appearance in the court below, failing which necessary adverse orders may be passed against him.

The BLAPL is accordingly disposed of.
