This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

None appears for the Petitioner at the time of call, so also no one had appeared on the last two occasions on 03.11.2022 and 19.01.2016. This Court by the last order has given one more chance to the Petitioner but he has failed to avail the same. This CRLMC application is pending before this Court since 06.01.2016 and in the meanwhile around six years have passed. Further, it appears from the prayer of the CRLMC, that the Petitioner has come up before this Court against the order of rejection passed in an application under section 227 of Cr.P.C. to discharge the Petitioner from the criminal case and the impugned order was passed way back on 21.11.2015 and in the meantime around seven years have already passed.

In view of the above facts, especially when no one has appeared today and on previous occasions for the Petitioner, it pre-supposes that the Petitioner is not interested to prosecute the matter. 4.
Hence, this CRLMC is dismissed.
