Heard learned counsel for the Parties.

In the previous approach of the Petitioner in W.P.(C) No.31315/2020 appears to have been disposed of by this Court directing to consider the issue involved by the competent authority. It appears, pursuant to such direction, the Labour Commissioner, Odisha-cum-Member Secretary, Odisha Building and Other Construction Workers Welfare Board in the proceeding, vide Annexure-3 has come to observe as follows :- "....Hence, the grievance petition of the Petitioner vide Annexure-5 of the W.P.(C) No.31315/2020 is disposed of with a direction to Sri Ananda Nayak, H/o.Malati Nayak (petitioner) At-Marada, PO-Baunsabati, P.S.-Fategarh, DistNayagarh to make application in form-XXXIV duly filled in all respect and produce all the relevant documents required

// 2 // as per letter No.138(32) dated 28.01.2017 of the Board as mentioned above before the District Labour Officer, Nayagarh, who shall take necessary steps to dispose the application."

Learned counsel for the Petitioner bringing this development to the notice of this Court and referring through the documents under Annexure-4 series submitted that following such direction, the Petitioner has already submitted the required documents and unfortunately, the competent authority is not finalizing the issue. 4.

Considering the innocuous prayer and unnecessary delay in considering such contentious issue, this Court in disposal of the Writ Petition directs O.P.3, Collector, Nayagarh and O.P.5, District Labour Officer, Nayagarh jointly to take decision on the issue involved herein following the observations at Page-12 of the Brief and supplementation of the documents, vide Annexure-4 series within a period of one month from the date of communication of this order along with copy of the Writ Petition by the Petitioner.
