Heard learned counsel appearing for the parties. Order No.

It is alleged that there is straightway move to provide police assistance in execution of a eviction drive to maintain the law & order situation in the locality particularly in absence of any proceeding involving the petitioner undertaken in the meantime. Mr.Panda, learned Additional government Advocate however submits that for the election process undertaken in between, there is no action on the notice at Annexure 1 as of now. Perusal of notice, this Court also finds, there was request for providing police deployment on 17.1.2022. This date has also lapsed in the meantime. In the event eviction drive involves has not taken place since police deployment was to be provided on 17.1.2022, this Court finds Annexure-1 has no force for the time being. This Court further taking into consideration the allegation of Mr. Bose, learned counsel for the petitioner, observes in the event there is no proceeding involving the petitioner and there is no order undertaking a eviction process without involving the petitioner, let the proceeding be
// 2 // re-opened and be disposed of in the involvement of petitioner, since he will likely to be affected for such eviction drive. 3.
