Heard learned counsel for the Parties.

The Writ Petition involves the following prayer :- "Therefore, it is humbly prayed that this Hon'ble court may graciously be pleased to ;

(i) Admit this writ application (ii) Issue Notice to the Opp.Parties and call for the relevant records;

(iii) Issue appropriate Writ/Writs, direction/directions to the Opp.Parties specifically to the Opp.Party No.3 for removal of such illegal encroachment from the government land i.e. plot No.478, Khata No.361 under Rajnagar Tahasil;

(iv) Issue appropriate order(s) direction(s) directing to the Opp.Party No.3 to consider and dispose of the representation of the Petitioner under Annexure-2 pending before him within a stipulated time period..."

In the event, the Tahasildar, Rajnagar, O.P.3 is in receipt of the Application under Annexure-2, he is directed to take decision on

// 2 // the same following the provisions of OPLE Act and also involving the parties, i.e., O.Ps.4 & 5 likely to be affected by completing the entire exercise within a period of six months from the date of communication of this order.
